**Consumer Protection. Rights and Obligations of the Seller and Buyer.**
**I. General Provisions**
The following document and provisions comply with the Consumer Rights Act dated May 30, 2014, Journal of Laws 2014, item 827 and have been in force since December 25, 2014.
The Seller is “Henc and Company” Paweł Henc, based in 67-200 Głogów, at 43b Jedności Robotniczej Street, NIP: 6931333758, tel.: 517 981 903, e-mail: eKursy.Henc@gmail.com.
The Buyer is any person purchasing any online course, hereinafter referred to as the Participant. The website that supersedes other course-specific websites is: www.zarabianienawakacjach.pl.

**II. Offer – Products and Services Available on the Website**
Goods or services sold by the Seller:
– Are owned by the Seller. For most of them, the Seller holds copyrights or license rights. For other content, the Seller possesses written permission to use and resell.
– The sale of courses does not violate applicable laws.
– All courses are precisely described and presented on each course’s website.

The Seller sells digital content and therefore must inform the Participant about hardware requirements and functionality of the digital content. These requirements are specified on each course’s website, e.g., https://www.animatorczasuwolnego.pl/wymagania-sprzetowe.
**III. Price**
The course price is specified in the “Enroll in the course” field. It is the gross and total price.
The course price may change during different sales seasons.
The Participant is subject to the course price at the time of ordering a specific course.
The Seller may offer sales discounts. The Seller independently determines the size, time, method, and recipient of these discounts.
**IV. Order Fulfillment Process**
– The Participant independently selects the course of interest.
– The Participant independently reviews the course offer, participation rules, and legal requirements.
– The Participant independently chooses their preferred course date.
– The Participant independently clicks on the selected “Enroll in the course” field.
– The Participant re-reads the course rules and requirements.
– On the www.ekademia.pl website, the Participant places an order for the selected course by filling in the required fields and clicking the “Order” button.
– The Participant independently chooses a payment method via https://www.payu.pl or directly transfers to the Seller’s bank account: mBank: 55 1140 2004 0000 3202 7491 1534, specifying their name, selected course, and email in the transaction title, e.g., Jan Nowak, Free Time Animator, janek@poczta.pl.
– After payment is recorded, the Participant receives an email with login, password, and course link, allowing them to start learning.
– The record time depends on the bank where the Participant processes the payment.
**V. Order Fulfillment Method**
– Certificates are sent upon completion of the course by all participants.
– Certificates are sent via regular mail through Poczta Polska, with delivery time entirely dependent on Poczta Polska, typically a few business days.
– On a written (email) request by the Participant, the Seller can issue and send the certificate faster.
– Certificates are sent within 3 business days of the course’s completion by all participants.
– Certificates sent on written (email) request are sent within 2 business days after receiving the Participant’s email request.
– The Seller may charge additional fees for shipping certificates via methods other than regular mail. The additional fee will be based on the pricing of the chosen transport or courier company.
– Costs of remote communication (telephone calls) are determined by telecommunication providers, with the phone call cost determined by the telecom company of which the Participant is a subscriber. The Seller does not profit from these calls.
– Remote communication costs for contract execution (Skype and email) are entirely free.
**VI. Returns**
According to the Consumer Rights Act dated May 30, 2014, Journal of Laws 2014, item 827:
– Article 38 specifies that the right to withdraw from a contract concluded off-premises or at a distance does not apply to service contracts fully executed by the entrepreneur with the consumer’s explicit consent, having been informed of the loss of withdrawal right upon full performance.
– The Seller is entitled to refuse refunds for courses chosen by the Participant.
– In adherence to fair-play, refunds may be given if requested within 10 days of purchase. The request must be via email to eKursy.Henc@gmail.com, acknowledging irreversible profile deletion and course access loss.
– Refunds may be reduced by PayU S.A. transaction fee and/or bank transfer costs, though typically not practiced, with the Seller usually covering the refund costs.
– No refunds apply to access fees for the course outlined on www.ewychowawca.com.pl.
**VII. Complaints**
– The Seller ensures the course, certificate, or diploma is delivered without defects.
– Should defects arise from the Seller’s fault, they bear all related costs.
– Defects arising from the Participant’s fault result in them bearing related costs.
– All complaints should be directed to “Henc and Company” at 67-200 Głogów, 43b Jedności Robotniczej Street, NIP: 6931333758, or via email: eKursy.Henc@gmail.com.
– Complaint processing takes 3 business days.
– The Seller will electronically inform the Participant of the complaint status within 3 business days.
– If justified, the Seller may offer a refund, replacement, or repair.
**VIII. Personal Data Protection**
– Data protection aligns with Article 13 of GDPR (General Data Protection Regulation), effective April 27, 2016, Official Journal UE L 119, 04.05.2016; personal data processed for course execution under Article 6, Paragraph 1, Point b GDPR; recipients include entities entitled by law; data stored till course completion and full settlement.
– Users have rights of data access, rectification, deletion, restriction, or objection, data portability, and complaint submission.
– Personal Data Administrator – “Henc and Company” manages certificate issuance: Paweł Henc, 67-200 Głogów, 43b Jedności Robotniczej Street, NIP: 6931333758, tel.: 517 981 903, e-mail: eKursy.Henc@gmail.com.
– Payment data processing handled by PayU SA, Poznań, adhering to PayU SA data protection regulations.
– Course data handled by Majewski Business Consulting, owner of www.ekademia.pl, follows their data protection regulations.
– Data may be shared with courier companies or Poczta Polska for shipment purposes.
– Data used for processing orders, marketing, certificate issuance, or reporting to educational supervising institutions.
– All data encrypted via SSL protocol, certified by Go Daddy Secure Certification Authority, Inc., USA.
– Databases registered with the Inspector General for Personal Data Protection.
– Participants can access their data.
– Participants can amend/delete their personal data in www.ekademia.pl’s “Profile.”
– Participants can unsubscribe from mailing lists through any automatic email (link in footer).
**IX. Order Execution Restrictions**
– Course sales are subject to statutory (Education System Act) and Seller’s requirements, including:
– Being of legal age.
– Possessing at least a secondary education.
– Not having a criminal record or pending criminal proceedings.
– For camp manager (recreation manager) courses, a minimum of 3 years of caregiving-educational work experience required.
– Courses target primarily Poland and the European Union but extend globally.
